GRAND RAPIDS, MI - A Comstock Park couple's rape of a 1-year-old girl while they video recorded the act has resulted in a possible life sentence for the woman and three consecutive life sentences for the male.
Kent County Circuit Court Judge Dennis Leiber said the acts perpetrated by Michael Justin Emory, 26, and Stevie Marie Foehl, 28, were so heinous that he did not describe them in open court on Thursday, Feb. 19.
"I don't know how to quantify the horror visited upon this child," Leiber said.
Emory will not be eligible for parole consideration for at least 75 years. Leiber ordered 25 year minimum on each of three offense for first-degree criminal sexual conduct. If paroled from the first term, the next will start and the process would repeat for the third conviction. Foehl's minimum sentence is also 25 years on her conviction.
The pair admitted they raped the 1-year-old daughter of a friend sometime around Oct. 25, 2012, in an apartment where the baby girl's brother and the couple's own children were present outside a locked bedroom door. The couple took turns recording one another assaulting the child, according to court records.
Leiber said that Foehl offered up the child as "sexual sacrifice" to Emory, but she also sexually assaulted the child. Police say the man raped the infant in a variety of ways.
On Thursday, Leiber asked Emory to offer an explanation for his actions.
"I ask myself how I could have gotten to this point," Emory said. "Every day I wish I could take this back."
Foehl said she hoped to be able to show that she is a changed person.
"To say I am remorseful is an understatement," Foehl said.
Police say they found videos and photographs of child pornography featuring the unidentified infant after searching the couple's York Creek apartment in August of 2013, after Emory was accused of assaulting a teen babysitter.
In January, Emory pleaded guilty to three counts of first-degree criminal sexual conduct involving a person under 13, child sexually abusive activity and using a computer to commit a crime.
Foehl pleaded guilty to one count of first-degree criminal sexual conduct, child sexually abusive activity and using a computer to commit a crime.
The couple was extradited to Michigan from South Carolina where they were arrested Aug. 16, 2013, after fleeing the state.
In his sentence, Leiber said he doubts that rehabilitation is possible for people capable of a crime of this nature.
Family members, who did not speak at the sentence hearing, said the baby is doing well.
